When an employment relationship breaks down

What employers and employees should each do when an employment relationship reaches its end.

Losing a job can create financial uncertainty and significant emotional pressure.

When an employee believes that an employment relationship has been improperly brought to an end, the first step should be to understand what actually happened.

Relevant documents may include:

  • the employment contract;
  • appointment letter;
  • workplace policies;
  • disciplinary correspondence;
  • termination or dismissal letter;
  • relevant emails or messages;
  • payslips and other employment records.
  • The distinction between termination and dismissal can also be legally important. Ghanaian employment law has developed through legislation and judicial interpretation, and questions concerning termination can depend heavily on the terms of the employment relationship and the circumstances in which it ended.

    A person should therefore avoid assuming that every employment dispute has the same legal answer.

    Facts matter. Documents matter. The applicable law matters.
